PREAMBLE

These general conditions of sale (the "General Conditions") are concluded between the Marchillsocks company and any non-commercial natural person (the User") wishing to make a purchase on the Website (hereinafter together referred to as the "Parties" ).
The Parties agree that these General Conditions exclusively govern their relationship. Marchillsocks reserves the right to modify the General Conditions from time to time. They will be applicable as soon as they are put online.
If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies are headquartered in France.

01 - PURPOSE
The General Conditions aim to define the terms of sale between Marchillsocks   and the User, from placing the order to after-sales services, including payment and delivery.

02 - PRODUCTS
The products governed by these Terms and Conditions are those which appear on the Website and which are indicated as sold and dispatched by Marchillsocks (the "Products"). They are offered within the limits of available stocks.
The Products are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, Marchillsocks   cannot be held liable.
The photographs of the Products are not contractual.

03 - PRICES
The prices of the Products are indicated in Euros, all taxes included. They take into account the VAT and any reductions applicable on the day of the order.
The prices displayed are subject to visible errors. In case of display of an erroneous price, obviously derisory (vile price), whatever the reason (computer bug, manual error, technical error.), the order - even validated - will be canceled, which we will we will inform you as soon as possible. You will then be able, if you wish, to place your order again at the corrected and exact price.
The prices of the Products are exclusive of delivery costs (shipping, packaging and making up the package according to the amounts in force). The amount of the delivery costs will be specified on the order form before validation of the order.
If one or more taxes or contributions, in particular environmental, were to be created or modified, up or down, this change may be passed on to the selling price of the Products present on the Website and on the various sales media.
However, a price cannot be modified once the User's order has been validated.

04 - THE ORDER

To place an order, the User must identify himself with his email address or his customer number and his password. For any first order, the User must follow an account creation procedure indicated on the Website.
In the event of loss or forgetting of the password, the User may request it again by going to his customer account. He will then receive his password on the email address he provided when registering.

Once the basket has been validated, the User must choose the address and delivery method, and validate the payment method, this last step formalizing the sales contract between Marchillsocks and the User.
Any order implies acceptance of the prices and descriptions of the products available for sale as well as the General Conditions. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below (article 7).
Marchillsocks will acknowledge receipt of the order upon validation by sending an email.
In certain cases, in particular non-payment, incorrect address or other problem on the User's account, Marchillsocks   reserves the right to block the User's order until the problem is resolved .
In case of unavailability of a Product ordered, the User will be informed by e-mail.
The cancellation of the order for this Product and its possible refund (only the Products available at the time of the order can be subject to a direct debit, as opposed to deferred products), will then be carried out, the rest of the order remaining firm and definitive.

05 - PAYMENT TERMS
Carte Bleue, e-carte bleue, Visa, Mastercard, Paypal, and any other means of payment offered on the site at the time of the order.

06 - DELIVERY
Registered orders are processed upon receipt and shipped within an average of 3 working days by the Colissimo service of the Post Office, to the delivery address provided by the buyer when ordering.
You will find delivery times (provided for information only) for each geographical area on the La Poste website.

07 - RIGHT OF WITHDRAWAL AND EXCHANGE

All Products delivered in Europe may be reimbursed except those excluded by law and bearing a mention to that effect, for example Products which have been personalized at the User's request.
The Products must be intact, complete, packed in the original packaging.
The User has a right of withdrawal of fourteen (14) days from the date of receipt or withdrawal of the Products.
The User can return his Product to Marchillsocks by La Poste. The return costs via La Poste are the responsibility of the User (with the exception of a defective Product upon receipt, or an error when sending the Product).
Marchillsocks undertakes to reimburse the User who has exercised his right of withdrawal the sums as soon as possible and at the latest within fourteen (14) days following the exercise of the right of withdrawal.
Marchillsocks will reimburse the User for the returned Products, subject to compliance with the conditions mentioned above, as well as the basic "one way" delivery costs of the latter if the User returns his entire order (deliveries with supplements are reimbursed within the limit of the basic delivery costs).
If the User does not return his entire order and retains one or more Products ordered, the amount of the "one-way" delivery costs will be retained by Marchillsocks.
The refund will be made via the payment method of the returned order.
Thus, if the Product order has been paid for by:
- Carte Bleue, and his Carte Bleue is still valid, the refund will be made to the account attached to this Carte Bleue
- Paypal, the refund will be made to the Paypal account

The User also has a period of fourteen (14) days to request an exchange.
The User will then not have to pay delivery costs on the new exchange order.
The User can return his Product to Marchillsocks by La Poste.
As a reminder, the return costs are the responsibility of the User.

8 - SIGNATURE AND PROOF
In all cases, the online supply of the bank card number and the final validation of the order will be worth proof of the entirety of the said order in accordance with the provisions of the law of March 13, 2000 and will be worth payment of the sums committed by the seizure of the Products listed on the order form.
This validation is equivalent to signature and express acceptance of all operations carried out on the Website.
However, in the event of fraudulent use of his credit card, the User is invited, as soon as this use is observed, to contact Customer Service at the address leo.billet@hotmail.fr
The computerized registers, kept in the computer systems of Marchillsocks and its partners under reasonable security conditions, will be considered as proof of the communications, orders and payments made between the Parties.
The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.

9 - RESPONSIBILITIES
Marchillsocks has an obligation of result for all the order taking stages as well as for the stages after the conclusion of the contract.
Thus Marchillsocks undertakes to describe with the greatest accuracy the products sold on the Website. On the other hand, Marchillsocks cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable event of a third party to the contract or to a case of force majeure as defined by French case law. Similarly, Marchillsocks   cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.

10 - INTELLECTUAL PROPERTY
All elements of the Website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. Similarly, the trademarks, logos, designs and models appearing on the Website are the exclusive property of Marchillsocks. Their disclosure can in no way be interpreted as granting any license or right to use any of the said trademarks and distinctive elements protected by copyright. They cannot therefore be used under penalty of infringement.
Thus, none of the documents from the Website may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever.
However, it is possible to download a copy of the documents on a computer for the personal use of the User and only for non-commercial purposes, provided that the User does not modify the information contained and that he keeps intact all copyrights and other proprietary notices. Modification of these documents or their use for any other purpose constitutes an infringement of the intellectual property rights of Marchillsocks
The User who has a personal website and who wishes to place, for personal use, on his website a simple link directly to the home page of the Website, must request authorization from the company. Marchillsocks. It will not be in any way an implicit agreement of affiliation.
On the other hand, any hypertext link referring to the Website and using the technique of framing or in-line linking is strictly prohibited. In any case, any link must be removed upon simple request from Marchillsocks

11 - PERSONAL INFORMATION
When ordering, personal data will be subject to computer processing.
The User is invited to refer to the Legal Notice and GDPR section of the Website to obtain all the information relating to this point.

12 - APPLICABLE LAW AND JURISDICTIONAL JURISDICTION
The General Conditions are subject to French law. The competent court in the event of a dispute will be that of Roanne.
The Website complies with French legislation, and Marchillsocks does not under any circumstances give any guarantee of compliance with the local legislation which would be applicable to you, when you access the Website from other countries.
